When content counts as a deep fake

Article 3(60) defines a deep fake as AI-generated or manipulated image, audio or video content that resembles existing persons, objects, places, entities or events and would falsely appear to a person to be authentic or truthful. Under Article 50(4), the deployer — whoever uses the AI system to create or alter the content in a professional capacity — must disclose that it has been artificially generated or manipulated.

A realistic image of a real person, place or event clearly qualifies. The Commission's July 2026 guidelines are widely reported to read "existing" as including subjects that could plausibly exist — so a photorealistic invented person may count too. See AI deepfake disclosure requirements for the full picture.

AI-generated text isn't a deep fake — for AI-written news and current-affairs content, use the public-interest text template.

Frequently Asked Questions

When do I need a deepfake disclosure?

Under Article 50(4), deployers of an AI system that generates or manipulates image, audio or video content constituting a deep fake must disclose that the content has been artificially generated or manipulated. Article 3(60) defines a deep fake as content that resembles existing persons, objects, places, entities or events and would falsely appear to a person to be authentic or truthful.

Does a photorealistic image of an invented person need this?

Possibly. The Commission's July 2026 guidelines are widely reported to read "existing" as including subjects that could plausibly exist, so a photorealistic invented person may count. The guidelines aren't binding and the point hasn't been tested, but the disclosure is cheap.

What about satire, parody or art?

Where the content is part of an evidently artistic, creative, satirical, fictional or analogous work, the obligation is limited to disclosing that generated or manipulated content exists, in a way that doesn't hamper the display or enjoyment of the work — the lighter template above.
