Article 50 for SaaS Companies

Being a SaaS company doesn't put you in scope of Article 50 — your AI features do. A SaaS product with no AI that talks to people or generates content has no Article 50 exposure at all. If you run an AI chat widget or ship AI features, here's how to tell what applies.

—Your product has no AI features that interact with people or generate content
—You use AI only internally — coding assistants, internal drafting — and don't publish deep fakes or AI-written public-interest text
—Your AI works entirely behind the scenes (ranking, fraud scoring, forecasting) without talking to people or generating content — that's outside the Article 50 obligations covered here

Which parts of Article 50 apply, and why

Art. 50(1) — interaction disclosure

If people interact directly with an AI system in your product or support channel, they must be told it's an AI unless that's obvious. The duty is written for the provider — which is you, for AI features you build and ship under your own name (Art. 3(3)).

Art. 50(2) — only if you generate content

If your product generates synthetic images, audio, video or text, the output must be marked in a machine-readable way. Features on the market before August 2, 2026 have until December 2, 2026 (Art. 111(4)).

A vendor widget is still on your site

The most common gap: an AI support widget with a human name

The pattern we see most is a support widget — often a vendor's, with its AI answers switched on — that greets visitors with a first name and an avatar and never says it's an AI. That's exactly the situation Article 50(1) targets, and with a friendly human persona it's hard to argue the AI is "obvious".
