Why it's required

Article 50(1) of the EU AI Act requires providers to ensure that people are informed when they're interacting with an AI system, unless this is obvious from context. It has applied since August 2, 2026, and breaches fall under fines of up to €15 million or 3% of worldwide annual turnover (penalties explained).

The obligation is written for whoever provides the chatbot, but the undisclosed AI is on your site — adding the disclaimer yourself is the simplest fix. For the full background, see Article 50(1) chatbot disclosure, explained.

Where to add it

✔In the chat window header, so it's on screen whenever the chat is open
✔As the bot's first message, before the visitor types anything
✔Not only in your footer, terms or privacy policy — the notice has to be where the conversation happens
✔Again at the handoff, if a human agent takes over from the bot

Frequently Asked Questions

Does my chatbot need an AI disclaimer?

If your site uses an AI system that interacts directly with visitors — like an AI chatbot — you're subject to the EU's chatbot AI disclosure requirement under Article 50(1), unless it's obvious to a reasonably well-informed, observant and circumspect person that they're dealing with an AI.

Do I need all three templates?

The banner or the greeting is the core disclosure — one of them, visible before the conversation starts, does the job. The handoff line is for widgets that switch between a bot and a human agent.

My chat vendor says their widget already discloses it's AI. Do I still need this?

Check what visitors actually see. If the widget clearly says it's an AI before the chat starts, you may already be covered. If it shows a human name and avatar with no AI notice, add one.
